These Referral Program Terms and Conditions ("Agreement") govern the referral program ("Program") offered by Zhdan A.V., an entity ("Company"), and are binding upon any individual or entity that participates in the Program ("Participant").
1. Eligibility: Participation in the Program is limited to individuals who are at least 18 years of age and who have a valid account on the Company's website.
2. Referral Reward: The Company offers two types of rewards for referrals:
- 1000 views on TikTok/YouTube/Reels = $1
- Each customer referred by a link = $3
3. Referral Link: To receive the referral reward for customer referrals, Participant must use the unique referral link provided on their dashboard. Participant shall share the referral link only with individuals whom Participant believes may be interested in the Company's product or service.
4. Eligible Referral: A referral is considered eligible only if the referred customer makes a purchase using Participant's referral link. The purchase must be made within 30 days of the referral date.
5. Reward Payment: The Company shall pay the referral reward earned through the Program to Participant via PayPal or other means deemed appropriate by the Company. Reward payments shall be made within 30 days of the eligible referral's purchase.
6. Limitations: Referral rewards are non-transferable and cannot be exchanged for cash or other benefits. Participant cannot earn rewards on their own purchases or purchases made using their own referral link.
7. Prohibited Activities: The following activities are strictly prohibited and may result in disqualification from the Program and/or legal action:
- Spamming individuals or groups with Participant's referral link.
- Making false claims about the Company's product or service.
- Creating multiple accounts to refer oneself or manipulate the Program.
8. Modification and Termination: The Company reserves the right to modify or terminate the Program at any time without notice. The Company may, in its sole discretion, disqualify any Participant who violates the terms and conditions of the Program.
9. General Terms: Participant agrees to comply with these terms and conditions and all applicable laws and regulations. Participant understands that the Company may use their name and likeness for promotional purposes related to the Program. This Agreement constitutes the entire agreement between Participant and the Company with respect to the Program and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between the parties.
10. Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of Ukraine, without giving effect to any choice of law or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of or related to this Agreement shall be instituted exclusively in the federal courts of the Ukraine, and Participant waives any objection to the venue, forum, or jurisdiction of such courts.
